Terms and Conditions
Preamble
The Digital Learning Hub (DLH) is a training center specializing in information technology, established in Luxembourg. It was created under the aegis of the Ministry of National Education, Children and Youth (MENJE) to promote continuous professional training through various pedagogical methods. Officially launched on May 16, 2022, the DLH contributes to the improvement of digital skills.
The Digital Learning Hub is duly accredited as a training organization by the Ministry of National Education, Children and Youth in accordance with the ministerial decree of September 29, 2023.
These general conditions govern the relationships between the DLH and its clients within the framework of the training services it offers.
Article 1 – Scope of Application
1.1 These general conditions apply to any registration and participation in training provided by the DLH, whether the participant is a natural person or a legal entity, public or private.
1.2 Registration for training implies full and complete acceptance of these general conditions, which the participant acknowledges having read, understood, and accepted. This acceptance is valid for the entire duration of the training.
1.3 These general conditions may be unilaterally modified by the DLH. Any modification will be published on the official DLH website.
1.4 These general conditions apply without prejudice to specific conditions individually agreed upon between the participant and the DLH within the framework of the subscribed services.
Article 2 – Registration Procedures
2.1 The number of participants in each training offered by the DLH may be limited due to constraints related to room arrangements, the level of pedagogical quality aimed for, or specific health directives. When the training is full, the indication "sold out" appears on the DLH website. In this case, the candidate can send an email to registrations@dlh.lu to request to be placed on a waiting list. If a spot becomes available, the candidate will be informed by email and can proceed with registration within the indicated deadlines.
2.2 Registration must be completed no later than 24 hours the start of the training. Confirmation is sent only after payment and validation of the minimum number of participants.
2.3 Registration is considered confirmed once it has been completed on the website and a confirmation email has been sent to the email address provided by the participant during registration.
2.4 Information regarding the language of the training and prerequisites is published on the DLH website. It is the sole responsibility of the participant to read this information before proceeding with registration. The DLH does not verify language skills or the satisfaction of prerequisites before registration.
2.5 The participant will receive a final confirmation of the session by email within five calendar days before the training date. This email will contain practical information about the training, including the exact schedule and location. When the training is scheduled for a Saturday, a reminder email will be sent to the participant the preceding Monday.
2.6 Registrations made within the framework of partnerships with Adem are limited to a period of three months before the start of the training.
Article 3 – Training Modalities
3.1 The dates, times, and locations of the training are specified on the DLH website at the time of registration.
3.2 The DLH reserves the right to organize training remotely, using means such as Microsoft Teams or any other appropriate platform. Participants will be informed in advance in case of modification of the format or organization of the training.
3.3 Unless otherwise stated, the training takes place at the following address: Digital Learning Hub 14, porte de France L-4360 Esch-sur-Alzette Belval, Luxembourg
3.4 Participants are required to comply with the conduct rules applicable within the DLH premises, as well as the internal regulations of the host establishments when the training takes place outside the DLH. This includes respecting the premises, the equipment provided, other participants, trainers, and all DLH staff.
3.5 The DLH reserves the right to exclude, at any time, any participant whose behavior disrupts the smooth running of the training. This exclusion does not entitle any form of compensation, reimbursement, or indemnity.
3.6 The pedagogical methods and tools used during the training are at the sole discretion of the trainer, depending on the pedagogical objectives of the session.
3.7 In case of unavailability of a trainer, the DLH reserves the right to replace them with another trainer with equivalent technical and pedagogical skills, without impacting the quality of the training.
Article 4 – Financial Conditions, Replacement and Cancellation Policy
4.1 Financial Conditions
4.1.1 The prices of the training are indicated on the DLH website at the time of registration.
4.1.2 Unless otherwise stated, all costs related to the necessary materials or pedagogical tools are included in the training price.
4.1.3 The total amount of the training is due immediately upon registration, unless otherwise stated
4.2 Payment Methods
4.2.1 Payment must be made by bank transfer, in accordance with the instructions provided during registration. Payment by bank transfer must be made within seven calendar days following registration and, in any case, before the start of the training. In case of non-payment within the allotted time, the DLH reserves the right to cancel the participant's registration.
4.2.2 If payment is not made within the allotted time, a reminder will be sent to the participant. If payment is not made following this reminder, access to the training will be blocked until full payment of the amounts due.
4.2.3 The prices indicated are exclusive of VAT and not subject to it under Article 8 of the amended law of February 12, 1979, on VAT.
4.2.4 The DLH reserves the right to adjust its prices at any time and without notice.
4.3 Replacement and Postponement Policy
4.3.1 Company/Public Entity: Any request to replace a participant or postpone to a later session must be sent by email to registrations@dlh.lu at least three calendar days before the start of the training. This request must include all necessary information regarding the participants and the training concerned. The DLH will confirm receipt of the request and communicate its response by email.
4.3.2 Individual: Requests to participate in a later session must also be sent by email to registrations@dlh.lu at least three calendar days before the start of the training, specifying the details of the participant and the training concerned. The DLH will acknowledge receipt and inform the requester of its decision by email.
4.4 Cancellation Policy
4.4.1 Cancellation by the participant: Any cancellation must be notified by email to registrations@dlh.lu at least three calendar days before the start of the training to be eligible for a refund. In case of unjustified absence ("no-show") or late arrival at a training, future training registrations will be blocked for a period of three months, without refund. Additionally, the training for which the participant is registered will be canceled without refund. For participants registered through Adem, any "no-show" will be reported to Adem.
4.4.2 Cancellation by the DLH: The DLH may cancel a training in the following cases: force majeure (technical failures, pandemic, suspension of training due to weather conditions, in accordance with MENJE policy, etc.); unavailability of the trainer; insufficient number of participants. In case of suspension of training due to weather conditions, the information will be published on the website www.dlh.lu. In all cases, a new date will be proposed, or a refund will be made if no postponement is possible or if the participant is unable to attend the new session.
4.5 Refund Policy
4.5.1 No refund will be granted in the following cases: unjustified or unreported absence from the training; late arrival or partial participation; voluntary abandonment or early termination, except in cases of duly established force majeure; absence for medical reasons without presenting a valid medical certificate.
4.5.2 A refund will be granted in the following cases: absence for medical reasons, justified by a medical certificate submitted within five calendar days following the absence; cancellation of the training by the DLH without the possibility of postponement; duly justified inability to attend the rescheduled session.
Article 5 – Communication
5.1 All official communications from the DLH with participants are conducted exclusively by email.

Article 6 – Certification Procedures
6.1 The training offered by the DLH does not include final exams or tests.
6.2 At the end of each training, a certificate of participation is issued to the participant. This document includes the following information: the participant's name; the title of the training attended; the date of the training; the number of training hours completed; the participant's attendance rate (if applicable).
6.3 The certificate of participation is sent to the email address provided by the participant during registration.
6.4 This certificate only attests to participation in the training and does not constitute an academic or professional certification, nor the awarding of ECTS credits.
6.5 Certificates of participation are issued in French and/or English, depending on the main language of the training.
Article 7 – Intellectual Property, Copyright, and Image Rights
7.1 The training materials provided to participants within the framework of the training are the exclusive property of the DLH or their respective authors. These materials, including texts, comments, works, illustrations, and images, are protected by intellectual property rights.
7.2 Any reproduction, representation, modification, distribution, or exploitation of all or part of these materials, in any form and for purposes other than those strictly related to the training, is prohibited without the express and prior authorization of the DLH or the concerned authors. Any violation of these provisions exposes the participant to legal action.
7.3 To ensure the protection of intellectual property rights and image rights of trainers and participants, it is strictly forbidden to record, film, or broadcast training sessions in any form, except with prior written authorization from the DLH.
7.4 In case of violation of copyright or image rights, the participant is subject to disciplinary sanctions, or even legal action, in accordance with the applicable legislation.
Article 8 – Responsibility, Obligations, and Duties of the DLH
8.1 The Digital Learning Hub (DLH) is an entity under the direction of the Ministry of National Education, Children and Youth (MENJE). It is responsible for organizing and coordinating training, administrative management, selecting and managing trainers, logistics, room reservations, managing registrations, and issuing certificates of participation.
8.2 The DLH cannot be held responsible for the adequacy or inadequacy of the training content with respect to the expectations or profile of the participants. Information regarding the prerequisites necessary to follow a training is made available to participants before registration. 8.3 The training offered by the DLH does not claim to provide complete or exhaustive coverage of the subject matter. They should not be interpreted as legal, technical, or professional advice. 8.4 The trainers involved in the training organized by the DLH are either internal collaborators of the MENJE or external experts selected by the DLH. No subcontracting is carried out within the framework of these services.
Article 9 – Data Protection
9.1 The participant is referred to the personal data processing policy, which they accepted when registering for training.
9.2 By registering for training, the participant or, where applicable, the entity registering participants (legal entity), agrees that the personal data provided will be processed by the DLH within the framework of the contractual relationship.
9.3 In the case where an entity (client legal entity) registers employees for training, it certifies that it has taken all necessary measures to inform these employees of the processing of their personal data. It also guarantees that it has communicated the legally required information regarding the transfer of this data to the DLH, at the latest at the time of their registration.
9.4 Participants agree to use the IT tools provided within the framework of the training responsibly, ethically, and in accordance with the purpose of the training. Any misuse, particularly for non-compliant purposes, is strictly prohibited.
9.5 In case of violation of the provisions relating to the use of IT tools or the processing of personal data, the DLH reserves the right to take appropriate measures, including: temporary or permanent suspension of access to IT tools and/or training; any necessary legal action to stop the violation or repair the damage suffered.
9.6 The processing of personal data is carried out in accordance with the General Data Protection Regulation (EU) 2016/679.
Article 10 – Complaints and Contract Termination
10.1 Any complaint relating to the execution of training or a training program must be made in writing and addressed to the DLH management at ld@dlh.lu within eight calendar days following the end date of the training or program concerned. To be admissible, the complaint must be transmitted by a means allowing for an acknowledgment of receipt.
10.2 The parties agree to seek an amicable resolution for any dispute arising from the execution of this contract. In case of failure of discussions within three months, the dispute may be brought before the competent courts of Luxembourg and, if necessary, justify the termination of the contract. 10.3 The DLH undertakes to process and respond to complaints within a maximum of 15 calendar days following their receipt.

Article 11 – Waiver
The fact that the DLH does not invoke, at a given time, one of the clauses of these general conditions cannot be interpreted as a waiver of its right to invoke it later.
Article 12 – Partial Nullity
If one of the provisions of these general conditions is deemed null or unenforceable by a competent court, this nullity or unenforceability will not affect the validity of the other provisions, which will remain fully in force.
Article 13 – Jurisdiction and Applicable Law
These general conditions, as well as their interpretation and execution, are governed by Luxembourg law. Any dispute relating to these conditions will be subject to the exclusive jurisdiction of the courts of the city of Luxembourg.
Article 14 – Modifications to the General Conditions
The DLH reserves the right to modify these general conditions at any time. The modifications will be published on the DLH website and will take effect immediately. It is the participant's responsibility to regularly consult these conditions to be aware of any updates.
